No, not 100% sure. Someone well intentioned still could call her his Victory. And why not?...are you sure?

... but this is a Hispanic Fregate, and 34 cannons; your model only shows 24 (26?) gun ports. This again makes me think it is a French frigate with 24/8-pounder cannons. Back to a square 1.
The 12-pounder frigates counted 26 and more cannons.

I like that!! If it's more than 26 guns, it could very well be 12- or 18-pounders.
It's an 18-pounder with 28 guns on the battery deck. One could check the rake of the stern; it's quite far from vertical. The tumble home seems moderate enough.
No, rather HMS Mystery. Or maybe the SMS Unbekannt.
