more replies are coming in from manufactures of Black Pearl merchandise and manufactures. There seems to be a consensus about it all.

Micro Mark sums it all up in a simple comment which echo's Ship in Scales stand


when asked about their selling of the Black Pearl and there comment on a facebook group of haters accusing people of supporting piracy without proof.


(Whether Model Ship Master sells reproductions or not is irrelevant. All currently produced wooden Black Pearl kits are unlicensed and therefore violate laws protecting IP.)


the answer is simple

I’d leave the debate up to the lawyers.

Yup... As we have said before, Disney does not claim Intellectual Property rights on wooden models of Black Pearls for several reasons:

1. Disney does not have any recorded Copyrights for Black Pearl wooden models. I personally researched ALL of them.
2. Disney does not have any copyrighted drawn plans for Black Pearl wooden models. The only drawings they have are for movie props.
3. Disney does not sell nor compete in the wooden model ship market.
4. The Black Pearl itself as portrayed in the movies is fictitious and has no fixed recorded design. In-fact, Mellpapa discovered Disney CGI artists changed it from scene to scene to suite production needs of the art directors.
5. In-fact, Disney benefits indirectly as a result of every Black Pearl model sold world-wide as it increases interest in watching the movies.
6. ALL wooden models of the Black Pearl that have ever been created, were produced from original design drawings NOT created by Disney.

This is why Micro Mark says leave the debate to the lawyers. Because Disney will NEVER pursue it, because it is of no interest to them and not in the best interest of the public. Public opinion is far more important to Disney than some argument over a wooden ship model.

Fair Use and International Free Trade ---- overrides the hater's argument and thier 200 followers.

i have contacted all the companies that produce anything concerning the Black Pearl and asked for a comment on them being accused of intellectual property theft by a facebook group of haters. The general consensus is no body is listening or cares what a little group of haters have to say.

We were also told that all others were either copies or illegal for whatever reason. I think anyone who has actually read this entire thread will now understand none of those statements are true.

one last comment do not be swayed by propaganda being spit out by haters to support their personal grudge.

not religion the hate talk and name calling.

when i send out emails to different companies both in manufacturing Black Pearl products and selling those products i include a list of links to this blog, to the open letter on this forum to the facebook hate group and and their supporters and anti bullying organizations. This give those people a full picture of the case for the Black Pearl.

From the beginning to now there never was a pirated kit or illegal black pearl kit it was all made up.

By sending out a mass mailing to as many people involved in any way shape or from of the black Pearl i am getting in return an over view of how both manufactures and retailers feel about it all.

As for the hater group it is glaring to many this group focuses on just one company and it's owner, just one forum and it's owner and a few people. This is not a organized movement to bring awareness to the problem on pirating or IP theft on a large scale it is a personal grudge and facts are twisted to support the grudge. It is very evident a blind eye is turned to some and not others. There are several forums that host build logs and many businesses both retail and manufactures that are gone "unnoticed" and that is why it got labeled as a hate group it is directed not at a problem but at a few people.

when it is all said and done it come down to the statement which we here on this forum have been saying from the beginning

i think the Flying Dutchman would be a welcome addition to Ship of Scale
 
This has been an interesting thread to follow. Thanks for your deep dive into the facts and for your opinions. I do not have a Facebook account, so am not able to get to any facebook conversations from the groups referred to. That's to my advantage as I don't need to view the adamant negative opinions about everything.

Regarding Mellpapa , I want to specifically thank him for posting his incredable work AND for explicitly stating that everyone is welcome to use his plans and systems, including the build log, for our use, free, no strings attached.

Thank you both for putting this out there to inspire and encourage us all to be creative and offering so many ideas to improve on our skills. Some of us like to build recreations, as close to the real thing as possible, to the last detail. Some of us like to add, embellish, create things as we see them in our head or remember from our life experience. But ALL of us are in this hobby to enjoy.

It is not a Facebook conversation. It is a Facebook "page" posted as "educational" that we are not allowed to comment on. Just today, this same page indicated they have reported SoS and all our members to Disney's "permissions department" (whatever that is) for building and talking about Black Pearl models. They also indicated they have an entire staff of legal experts that know far more about these matters than us self-taught amateurs.

HAHAHAHA....
